Terms of Service

The short version: this is a study tool for the EPPP. It is not therapy and not clinical advice. You can cancel any time and keep your access until the period you paid for runs out. The pass guarantee gives you free time on your subscription, not a refund, and it never promises you will pass.
1. Who we are and what these terms cover
thePsychology.ai is run by Anders Chan, PsyD, doing business as thePsychology.ai, at 761 Harrison Ave, HC 630, Boston, MA 02118. In these terms, “we” and “us” mean that business, and “you” means the person using the product.
These terms cover one thing: the thePsychology.ai EPPP study product. That is the study product we call the Service, and it includes the AI-adaptive question bank, full practice exams, the diagnostic that ranks your weakest domains, the study plan built from your score report, the read-aloud lessons, and the automated study assistant chat. It covers that product on the web and in our iPhone app.
The therapy practice is separate and is not covered here. We also run a clinical therapy practice on the same website, at pages like find-therapist, client, and provider. That practice has its own agreements, its own privacy practices, and its own rules. Nothing on this page applies to it, and nothing on this page creates a clinical relationship of any kind.
The Service is study material. It is not therapy, counseling, clinical care, supervision, or professional advice. It does not create a therapist and client relationship, and it does not create a supervisor and supervisee relationship. If you need clinical care, please see a licensed provider.
You have to be 18 or older to use the Service. By using it, you agree to these terms.
2. Not affiliated with ASPPB
We are not connected with ASPPB, the EPPP, or any licensing board, and they do not endorse us. We do not write the EPPP, we do not score it, and we do not decide who gets licensed. EPPP and ASPPB are the names of other organizations, and we use them only to say what our study material is about.
3. AI-generated content
Some of our questions, explanations, study plans, and audio are made or drafted by AI and then checked by us. We work hard to get them right, and we still get things wrong sometimes. AI can be confidently wrong.
- Treat everything here as study material, not as a source you would cite or rely on for real decisions.
- Nothing in the Service is clinical advice, a diagnosis, or a treatment recommendation for any real person.
- The study assistant chat is automated software, not a person. It is not a therapist, a tutor you have hired, or a licensed professional giving you advice.
- Found something wrong? Tell us at DrChan@thepsychology.ai and we will look at it.
4. Your account
- Give us accurate information when you sign up, and keep it current.
- Keep your login private. You are responsible for what happens under your account.
- One person per account. Accounts are not shared and not transferable.
- Tell us right away if you think someone else got into your account.
- We can suspend or close an account that breaks these rules. If we do, we will tell you why.
5. Free trial and free tier
The free trial takes no card. There is nothing on file to charge, so the trial never turns into a payment on its own. Nothing converts by itself, ever.
When your trial ends, your account drops to the free tier. You keep your account and your history, with less access. If you want full access after that, you choose a paid plan yourself.
6. Paid plans, auto-renewal, and how to cancel
Paid plans are monthly or yearly. Right now a new monthly subscription is $60 a month and a new yearly subscription is $349 a year. The price that binds you is the price shown on the checkout page when you subscribe, and that page always shows the amount, the billing period, and the date of your first charge before you pay.
Plans renew on their own until you cancel. A monthly plan bills every month, a yearly plan bills every year, on the same card, until you stop it.
- Before you pay, you tick a separate box saying yes to the repeating charge. That box is only about auto-renewal.
- After you subscribe we email you a confirmation you can keep, with the amount, the billing period, and how to cancel.
- Cancel in one click from your account settings, any time. No phone call, no email chain, no reason required.
- When you cancel, your access continues to the end of the period you already paid for. We do not cut you off early.
- Email DrChan@thepsychology.ai if the button ever fails you. Email works as a backup way to cancel.
- On a yearly plan we email you a reminder 15 to 45 days before your renewal date, so the charge is never a surprise.
- Your rate is locked while you stay subscribed. Price steps apply to new subscriptions only. If we ever change that policy, we will email you at least 30 days before it touches your plan, and you can cancel before it does.
7. Apple App Store purchases
If you subscribed inside our iPhone app, Apple handles that purchase, not us. Apple bills you, Apple cancels it, and Apple decides refunds for it. We cannot do any of those three from our end.
- Manage or cancel an App Store subscription in your Apple account settings, on your device.
- For that purchase, Apple’s terms and refund rules apply. Where Apple’s terms and ours disagree about billing, Apple’s win.
- Everything else in these terms still applies to how you use the Service.
8. Refunds
Payments are not refundable, except where the law requires a refund. Cancelling stops your next charge and leaves your current period alone.
Billing mistakes are a different thing. If we charged you the wrong amount, charged you twice, or charged you after you cancelled, tell us and we will fix it.
9. The pass guarantee
We offer a conditional pass guarantee. The full rules, every condition, and the claim steps live on the guarantee page, and that page is part of these terms.
Here is the remedy in one paragraph. If you meet every condition, sit the EPPP, and do not pass, your next 6 months are free. On a monthly plan we pause your billing for 6 months. On a yearly plan we push your renewal date back 6 months. Your access stays on the whole time. It is free time on your subscription. It is not a refund of money you already paid, and it is not a promise that you will pass or that you will get any particular exam result.
Pay through the App Store? Apple runs that billing, so we cannot pause it from here. Email us and we will give you the 6 free months another way.
Your guarantee terms are locked to your version. The guarantee terms that apply to you are the ones published on the date of your first paid payment, not the date you file a claim. New guarantee terms never reach back over a member who was already paying.
The guarantee is the only promise we make about outcomes, and it is not a promise that you pass. Nothing else we say anywhere, including our ads, our emails, and our website, adds a promise about your exam result.
10. The exam debrief and ASPPB nondisclosure
On the current guarantee terms, filling in the exam debrief is one of the conditions of a claim. The debrief asks about our prep material, never about theirs.
Never share real exam content with us. Your ASPPB candidate agreement says you cannot, and we are not asking you to. Never type a real question, a real answer, or a real topic you saw on exam day, anywhere in the Service.
- Every debrief question is about how our material compared with exam day, not about what was on the exam.
- The debrief is private product research. It is not a review, a rating, or a testimonial, and we never ask you to post anything in public to get the benefit.
- We never publish your debrief or share it outside our team without your separate written permission first.
- If you send us real exam content anyway, we will delete it, and we may have to deny the claim.
11. Score reports and your data
What we collect and what we do with it is written out in our Privacy Policy, which is part of these terms.
A score report you upload for a guarantee claim contains your legal name and your ASPPB candidate ID. We use it only to decide that claim. We store it with restricted access, we never use it for marketing, and we delete it after the decision is final and no later than 12 months after that.
Never type patient or client details anywhere in the Service. No names, no case details, no session notes, nothing that identifies a real person you work with. This is a study product. It is not built for protected health information, it is not covered by HIPAA, and there is no place in it where that information belongs. If you send us any, we will delete it.
12. Referral program and monthly prize
You can share your referral link with people who might want the product. Here is how it pays out:
- Your friend gets their first month free when they subscribe through your link.
- You pick your thank-you once that friend makes their first real payment: a free month on your own subscription, or $25 sent by Venmo or Zelle. Nothing pays out on a signup or on a $0 checkout.
- Each month, the person with the most paid referrals wins $200. You need at least 3 paid referrals that month to qualify. Each month closes on its last day at 11:59pm ET. If nobody reaches 3, the $200 rolls into the next month and the pot grows.
- Rewards are capped at 4 per referrer per rolling year, and one reward per referred person, ever.
- Referring yourself does not count, and neither do fake or duplicate accounts. Those get no reward, and we may close them.
- Cash rewards may count as taxable income to you. We may need your tax details before we can pay a cash reward, and we may have to report it.
- We can change or end the referral program at any time. Rewards you already earned are not taken away.
13. Our content and your license
We own our product. That includes how we select, arrange, and compile the material, the edits and explanations our people write, our study method, our software, and our name and branding. Facts about psychology belong to everyone. Our particular collection and presentation of them is ours.
While your account is in good standing, you get a personal, non-commercial, non-transferable license to use the Service to study. That is the whole license. It ends when your account does.
Do not do any of this with our content:
- Copy it, scrape it, record it, or screenshot it in bulk.
- Share it, distribute it, publish it, or resell it.
- Use it to train, fine-tune, or evaluate an AI model, yours or anyone else’s.
- Use it to build a competing study product, or feed it into one.
Feedback and debriefs you send us. When you send us feedback, bug reports, or a guarantee debrief, you give us a perpetual, worldwide, royalty-free license to use it to improve the product. We never publish it, and we never share it outside our team, without your separate written consent first.
14. Acceptable use
Do not do these things in the Service:
- Run bots, scrapers, or scripts against it.
- Download the question bank or the lessons in bulk.
- Share your login, sell your access, or resell any part of it.
- Use any of it to train or evaluate an AI model.
- Get around rate limits, paywalls, or any other technical limit.
- Harass anyone, or send abusive or threatening messages.
- Break the law with it, or try to break into it.
- Upload malware, or anything that could damage the Service or another user.
If you do, we can suspend or close your account, and we can refuse to serve you in future.
15. Ending your account
You can close your account at any time from Delete your account, or by emailing DrChan@thepsychology.ai. Here is exactly what happens when you do:
- Your subscription is cancelled right away, not at the end of the period. If you want to use the days you already paid for, cancel your subscription first and delete the account later.
- Any score report you uploaded for a guarantee claim is deleted from our storage.
- Your login is deleted, so you are signed out and cannot sign back in.
- We keep the records we need for billing, tax, and legal reasons. Our Privacy Policy covers what we hold and how to ask us about it.
We can also close your account if you break these terms, or if we stop offering the Service.
16. Disclaimers
The Service is provided as is and as available. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not promise that:
- Every question, explanation, or audio lesson is accurate.
- Our material matches what is on any real EPPP.
- The Service is always up, or free of bugs and errors.
- You will pass the EPPP, get any particular score, or get licensed.
Some places do not allow these exclusions. Nothing here takes away any consumer right you have that cannot be waived under the law where you live.
17. Limits on our liability
To the fullest extent the law allows, our total liability to you for any claim is capped at the greater of two amounts: what you paid us in the 12 months before the claim, or $100.
We are not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost data, or lost opportunities. That includes anything to do with your exam outcome, your licensure, or your career.
These limits do not apply to our gross negligence, our willful misconduct, our fraud, or personal injury we cause. Some places do not allow these limits. Nothing here takes away any consumer right you have that cannot be waived under the law where you live.
18. Your responsibility to us
If you break these terms or break the law using the Service, and that costs us money, you cover those costs. That means claims brought against us because of what you did, and the reasonable legal fees that come with them. We will tell you promptly if a claim like that comes in, and we will not settle it without talking to you.
19. Changes to these terms
We can update these terms. For any material change, we email you at least 30 days before it takes effect, and we ask you to agree to the new version before it applies to you. If you do not agree, you can cancel.
Small fixes like typos, clearer wording, or a new contact address take effect when we post them.
This section does not touch the guarantee. Guarantee terms are locked to the version published on your first paid date, as described in section 9. Changing this page never changes the guarantee terms you are on.
20. How we settle disagreements
Talk to us first. Before either of us starts a formal case, the one with the problem sends the other a written notice describing it and what would fix it. Send yours to DrChan@thepsychology.ai. We both then have 30 days to try, in good faith, to sort it out between us. Most things end here.
If that does not work, we use arbitration. Any dispute we cannot resolve informally is settled by binding arbitration, one on one, run by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration is a private process with a neutral decider instead of a judge and jury. The arbitrator’s decision is final and a court can enter it as a judgment.
You can opt out, and you have 30 days. If you do not want this section to apply to you, email DrChan@thepsychology.ai within 30 days of first accepting these terms and say you are opting out of arbitration. That is all it takes. Opting out costs you nothing, changes nothing else about your account, and we will not treat you differently for it.
- Small claims court is always open. Either of us can bring a qualifying case in small claims court instead of arbitration, and this section does not stop that.
- Individual cases only. Claims are brought one person at a time. You and we both give up the right to bring or join a class action, a class arbitration, or any other case brought on behalf of a group. The arbitrator can only decide your own claim and can only award relief to you.
- Who pays for it. Arbitration costs follow the AAA Consumer Arbitration Rules. You pay at most the consumer filing fee set by those rules, and we pay the rest of the arbitration fees.
- The arbitrator decides what this section covers. Questions about whether a dispute belongs in arbitration, and about how to read this section, go to the arbitrator and not to a court.
- If the group-case waiver does not hold up. If a court decides the waiver above cannot be enforced for a particular claim, then that claim alone goes to court instead of arbitration. Every other claim still goes to arbitration.
- Where court cases happen. For anything that does end up in court under this section, the place is New York.
21. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict of laws rules.
Nothing here takes away rights your own state’s consumer protection laws give you. If your state gives you a right you cannot waive, you keep it.
22. Copyright complaints
Think something in the Service infringes your copyright? Email DrChan@thepsychology.ai and include:
- What work you say was copied.
- Where it appears in our product, with a link or a screenshot.
- Your name, address, phone number, and email.
- A statement that you believe in good faith the use is not authorized, and that your notice is accurate.
- Your signature, physical or electronic.
We look at every notice, and we remove content that infringes. We also close the accounts of people who infringe repeatedly.
23. Sanctions and export
You cannot use the Service if United States sanctions or export rules say we cannot serve you. That includes being located in a sanctioned country or region, and being on a restricted party list. By using the Service you confirm that neither is true of you.
24. California users
Under California Civil Code section 1789.3, California users can reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
25. General
- Severability. If a court decides one part of these terms cannot be enforced, the rest still stands.
- Assignment. You cannot transfer your account or these terms to someone else. We can transfer them if our business is sold or merged.
- Entire agreement. These terms, the Privacy Policy, and the guarantee terms are the whole agreement between us about the Service.
- Notices. We send notices to the email on your account, so keep it current. You send notices to us at DrChan@thepsychology.ai.
- No waiver. If we do not enforce a rule right away, we can still enforce it later.
- Force majeure. We are not responsible for delays or outages caused by things outside our control, like natural disasters, war, power or internet failures, or a vendor going down.
- Survival. Sections 13, 16, 17, 18, 20, 21, and 25 stay in force after your account ends.
